Sir: -

I am directed by Secretary Sir E. Grey to ack-

nowledge the receipt of your letter No.24978/09 of

the 16th instant, relative to the constitution of

the proposed Court of Appeal in Hong Kong.

In reply, I am to state, for the information of

the Secretary of State for the Colonies, that Sir E.

Grey will be prepared to consider the scheme afresh on

the retirement of the present Chief Justice of Hong

Kong, but that he cannot pledge himself that the work

of His Majesty's Supreme Court at Shanghai will then

render it feasible for the scheme to be carried out.

Lord Crewe will no doubt remember that Sir Ed-

ward has, from the first, made his consent contingent

on the concurrence of Sir H. de Sausmarez, the Judge

of the Court at Shanghai, in the scheme.
